Canada extends refugee protection to individuals facing well-founded fear of persecution, preventing them from returning to their home country due to unforeseen circumstances. The fear might be based on
various factors including but not limited to religion, race, fear of punishment, political views, or membership of a particular political or social group. The Canadian refugee system has two main parts:

  • The Refugee and Humanitarian Resettlement Program, for people who need protection from outside Canada; and
  • The In-Canada Asylum Program for people making refugee protection claims from within Canada.

Upon receipt of your refugee claim within Canada, IRCC/CBSA Officers will determine its eligibility for referral to the Immigration and Refugee Board of Canada (IRB) for a comprehensive decision on
immigration and refugee matters. The IRB plays a crucial role in identifying Convention refugees or individuals in need of protection.

Depending on the nature of your refugee claim, if the immigration officer or the panel member of the Immigration and Refugee Board (IRB) refuses your claim, you can appeal the decision in the Federal Court.
